DIFFERENCE BETWEEN REJECTION AND RETURN OF PLAINT
RETURN OF PLAINT:-
Order 7 rule 10 of code of civil procedure 1908
The plaint shall at any stage of the suit be returned to be presented to the court in which the suit should have been presented.
PROCEDURE OF RETURN OF PLAINT:-
Order 7 rule 10(2) of code of civil procedure 1908
On return a plaint the judge shall endorse thereon the date of its presentation and return.
REJECTION OF PLAINT:-
Order 7 rule 11 of code of civil procedure 1908
Court may reject the plaint if requirements of law are not fulfilled, rejection can be made on different grounds
i- Plaint not disclosing cause of action
ii- Relief claimed is undervalued
iii- Plaint is insufficient stamped
GROUNDS OF REJECTION OF PLAINT:-
Following are the grounds of rejection of plaint
i- Plaint not disclosing cause of action
ii- Relief claimed is undervalued
iii- Plaint is insufficient stamped
